 Petitioners Seeking Rezoning

 

INSTRUCTIONS FOR PETITIONERS SEEKING REZONING OF PROPERTY

BY THE CITY OF IRONDALE

1. Definition of "Petitioner": that individual, agent, representative, partnership, corporation, etc., requesting rezoning of property from the City who is the Owner of said property, or who is designated by the Owner to act as the Owner's representative at the various hearings of the City.

 

2. The Petitioner shall request a date for a public hearing before the Irondale Planning and Zoning Commission.  Regular meeting date is set for the last Thursday of each month at 7:00 PM in the Council Chambers of Irondale City Hall.  Such requests shall be made no less than twenty (20) calendar days prior to the meeting date and shall be made to the Planning Commission or the City Clerk and filed with the Zoning Administrator.  Requests for rezoning shall be accompanied by a $100.00 processing fee.

 

3.  The City's Zoning Administrator shall furnish the Petitioner letters of notification to all property owners within five hundred (500) feet of the site proposed for rezoning.

 

4.  The Petitioner shall arrange to have these notices picked up from the Zoning Administrator's office and mailed via Certified Mail-Return Receipt no later than sixteen (16) days prior to the date of the Public Hearing.  The Petitioner shall retain all return receipts and deliver said return receipts to the City Clerk the night of the hearing.

 

5.  The Petitioner shall be present at the Irondale Planning and Zoning Commission  public hearing to present the case to the Commission and answer any questions concerning the rezoning request.

 

6.  After review of the request for rezoning and listening to all public comment concerning the effects of said rezoning, the  Irondale Planning and Zoning Commission will act as follows:

 

            a. Recommend to the City Council that rezoning is approved;

           

b. Continue the public hearing at a later date so as to allow time for the Irondale Planning and Zoning Commission  to gather information to render a decision; or,

 

c.  Reject recommendation for rezoning.

 

7.  Upon favorable recommendation by the Irondale Planning and Zoning Commission or on appeal of rejection, the Petitioner shall request a date for a public hearing before the Irondale City Council.  Regular meeting dates are the first and third Tuesdays of each month at 7:00 PM in the Council Chambers of Irondale City Hall.  Such requests shall be made no less than twenty (20) calendar days prior to meeting date and shall be made to the City Council or the City Clerk and filed with the Zoning Administrator.

 

8.  The Zoning Administrator's office shall furnish the Petitioner a letter of notification to all property owners within five hundred (500) feet of the Proposed Site for Rezoning.

 

9.  The Petitioner shall arrange to have these notices picked up from the Zoning Administrator's office and mailed via Certified Mail-Return Receipt no later than sixteen (16) days prior to the date of the Public Hearing.  The Petitioner shall retain all return receipts and deliver said return receipts to the City Clerk the night of the hearing.

 

10. The Petitioner shall be present at the Irondale City Council Meeting to present the case to the Commission and answer any questions concerning the rezoning request.

 

11.  After review of the request for rezoning and listening to all public comment concerning the effects of said rezoning, the City Council will act as follows:

 

a. Motion to approve rezoning and adoption of a City Ordinance to rezone the property;

 

b. Continue  the public hearing at a later date so as to allow time for the Irondale City Council to gather information to render a decision; or,

 

c.  Motion to reject the zoning request.

 

12. Upon adoption of the Ordinance by the Irondale City Council, the City Clerk shall furnish the Petitioner a copy of the City Rezoning Ordinance.

 

13.  If the City Council denies rezoning, the Petitioner may file suit with the Circuit Court of Jefferson County.

Note:

    The following is a list of items the Petitioner must provide the Commission and Council:

           

       When a change in zoning district boundaries is requested to become R-3, R-4, R-5, R-6, R-7, INST, or any Commercial or Industrial zone a site development plan shall be submitted for review at the time the petition for change is submitted.  A site development plan shall consist of a map, drawn to a legible scale, showing the site of the requested zoning change and each adjoining property.  The site development plan shall show the dimensions of the property along with all existing and proposed structures and/or buildings, driveways, parking areas, and required greenbelt or proposed buffer areas of both the site of the requested zoning change and each adjoining property.  The site development plan shall show the nature and location of all existing and proposed storm drainage facilities and shall include a  statement of anticipated traffic volumes which would be generated by the change in zoning.
